Thank you for your interest in Nim. This Privacy Policy (“Privacy Policy”) sets out how we collect, use, and manage the personal information we receive from you or a third party in connection with our provision of services to you or which we collect from your use of our website https://nim.video/ (“Site”) and our other associated services (”Services”). All references to “Company”, “we”, “us”, “our”, or “Nim” refer to Nim AI Inc., a Delaware corporation.

Before using this Site or the Services, please read carefully and thoroughly understand this Privacy Policy.

By accessing or using this Site or the Services, you signify acceptance of the terms of this Privacy Policy as well as the Terms of Service.

Personal information we collect

Information you provide to us:

  • Contact data, including your name, email address, phone number, and mailing address.
  • Profile information, such as username, password, profile picture, biographical details, and preferences you set for your account.
  • Demographic data, including your age, city, state, country of residence, and postal code.
  • Communication data from our interactions with you, whether through our Site, social media, or other channels.
  • Payment and transaction details necessary for processing your purchases, including payment card information and billing data. We use a third-party payment processor and do not directly store your financial information.
  • Marketing preferences, including your choices for receiving our communications and your engagement with them.
  • User-generated content, including but not limited to images, videos, text inputs, comments, messages, and other materials you create, upload, or share through our Site or Services, along with associated metadata.
  • Feedback and correspondence, such as survey responses, product reviews, or inquiries you submit to us.
  • Other information you choose to provide, which we will use in accordance with this Privacy Policy or as disclosed at the time of collection.

Information we obtain from third parties:

  • Social media information. We may maintain pages on social media platforms, such as Facebook, LinkedIn, Instagram, and other third-party sites. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may share information with us through the platform, and we will handle such information in accordance with this Privacy Policy.
  • Other Sources. We may collect your personal information from various third parties, including marketing partners, data providers, and sources that are publicly available.

Automatic data collection. We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Site and Services, our communications and other online services, such as:

  • Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including those used for advertising purposes), language settings, mobile carrier, radio/network information (e.g., WiFi, LTE, 4G), and general location information such as city, state, or geographic area.
  • Online activity data, such as the pages or screens you viewed, the time you spent on each page or screen, your browsing history, the navigation paths between pages or screens, details about your activity on a page or screen, access times and duration, and whether you have opened our marketing emails or clicked on links within them.
  • Communication interaction data, including information regarding your interactions with our emails, text messages, or other forms of communication (e.g., whether you open or forward emails). We may collect this data through the use of pixel tags (also known as clear GIFs), which may be embedded invisibly within our emails.

Tools we use for automatic data collection:

  • Cookies, which are small text files stored on user devices by websites, allowing web servers to track users' web browsing activities and remember their submissions, preferences, and login status as they navigate a site. The cookies used on our Site include "session cookies" that are deleted when a session ends, "persistent cookies" that remain for a longer duration, "first party" cookies that we place and "third party" cookies that our business partners and service providers place.
  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.

Data about others. We may provide features that allow users to invite their contacts to use the Site and the Services, and we may collect contact information about these invitees in order to send them invitations. Please ensure that you have obtained permission before referring someone to us or sharing their contact details.

How we use your personal information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

Service delivery and operations:

  • To provide, operate, maintain, and improve our Services and business;
  • To process payments and complete transactions;
  • To establish and maintain your user profile;
  • To enable security features and remember your devices and preferences;

  • To create de-identified, aggregated, or anonymized data from your personal information;
  • To use and share this de-identified, aggregated, or anonymized data for lawful business purposes. These purposes include analytics, research, analyzing and improving our Site and Services, promoting our business, training our artificial intelligence models, and other machine learning purposes.

With your consent. In some cases, we may ask for your explicit consent to collect, use, or disclose your personal information, or we may act based on your request or direction.

Legal Bases for Processing European Personal Information. If you are located in the EEA or the UK, we only process your personal information when we have a valid legal basis, including as set forth below.

Consent. We may process your personal information where you have provided your explicit consent for specific processing activities.

Contractual Necessity. We may process your personal information as necessary to provide our Services to you and fulfill our contractual obligations.

Compliance with Legal Obligations. We may process your personal information where required to comply with applicable laws and regulations.

Legitimate Interests. We may process your personal information where we or a third party have legitimate interests in doing so. These legitimate interests include product development, internal analytics, and improving the safety, security, and performance of our Site and Services. We ensure that our legitimate interests do not override your rights and interests.

How we share your personal information

We may share your personal information with the following parties and as otherwise described in this Privacy Policy, in other applicable notices, or at the time of collection:

  • Service providers. Third parties that provide services on our behalf or help us operate our Site, Services, and business, including hosting, information technology, customer support, email delivery, marketing, consumer research, analytics, and AI providers;
  • Payment processors. Any payment card information you use to make a purchase on our Site or through our Services is collected and processed directly by our payment processors, who may use your payment data in accordance with their own privacy policies;
  • Professional advisors. Lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services they render to us;
  • Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for compliance, fraud prevention, and safety purposes;

We may disclose personal information in the context of actual or prospective business transactions (e.g., investments in the Company, financing, public stock offerings, or the sale, transfer, or merger of all or part of our business, assets, or shares). For example, we may need to share certain personal information with prospective counterparties and their advisers. We may also disclose your personal information to an acquirer, successor, or assignee of the Company as part of any merger, acquisition, sale of assets, or similar transaction, and/or in the event of an insolvency, bankruptcy, or receivership in which personal information is transferred to one or more third parties as one of our business assets;
  • Advertising partners. Third-party advertising companies for interest-based advertising purposes as described in this Privacy Policy;
  • Third parties designated by you. We may share your personal information with third parties when you have instructed us to do so or have provided your consent;
  • Business and marketing partners. Third parties with whom we co-sponsor events or promotions, jointly offer products or services, or whose products or services may be of interest to you;
  • Other users and the public. Your profile and other user-generated content data may be visible to other users of our Site and Services, as well as to the public. For example, other users or the public may have access to your information if you choose to make your profile or other personal information available to them through the Site or the Services, such as when you invite collaborators, provide comments, reviews, or share other content. This information can be seen, collected, and used by others, including being cached, copied, screen captured, or stored elsewhere by others (e.g., search engines), and we are not responsible for any such use of this information. Under certain subscription tiers, all your generated content will be publicly accessible by other users on the platform unless you upgrade to a higher subscription tier, which offers the option to opt out of this feature.

Your Choices

Access or update your information. If you have registered for an account with us through the Site, you may review and update certain account information by logging into the account.

Opt out of communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Please note that if you choose to opt out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.

Cookies and other technologies. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Site may not work properly.

Blocking images/web beacons (clear gifs). Most browsers and devices allow you to configure your device to prevent images from loading. To do this, follow the instructions in your particular browser or device settings.

Advertising choices. You may be able to limit the use of your information for interest-based advertising through the following settings/options/tools:

You will need to apply these opt-out settings on each device and browser to limit the use of your information for interest-based advertising. We cannot guarantee that the companies we work with participate in the opt-out programs described above.

Linked third-party platforms. If you choose to connect to our Site or Services through your social media account or other third-party platform, you may be able to use your settings in your account with that platform to limit the information we receive from it. If you revoke our ability to access information from a third-party platform, that choice will not apply to information that we have already received from that third party.

Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit.

Declining to provide information. We need to collect certain personal information to offer specific services. If you do not provide the information we identify as necessary or mandatory, we may not be able to deliver those services.

Delete your content or close your account. You can delete your account, which will also remove all associated assets. To close your account, you can either reach out to us directly or initiate the account deletion process from within the Site.

Other rights based on location. Depending on your place of residence, you may be entitled to some or all of the rights listed below regarding your personal information. However, please note that these rights are not absolute and may only apply under certain circumstances:

  • You have the right to request the deletion of your personal information, either in whole or in part;
  • You have the right to request the correction or modification of your personal information, particularly if it is inaccurate or incomplete;
  • You have the right to object to the processing of your personal information for specific purposes or to request the restriction of its processing;
  • You have the right to request access to your personal information held by us;
  • You have the right to withdraw your consent to our processing or controlling your personal information at any time.

Supplemental Notice for California Residents

This Supplemental Notice applies if you are a resident of California, Colorado, or another U.S. state that has enacted a privacy law similar to the California Consumer Privacy Act (CCPA) and requires specific privacy notice disclosures. The CCPA provides such residents with the right to know what categories of personal information we have collected about them and whether we disclosed that personal information for a business purpose (e.g., to a service provider) in the preceding 12 months.

For purposes of the CCPA, we do not “sell” (under the CCPA) the personal information of minors under 18 years of age.

Subject to certain limitations, the CCPA provides California consumers the right to request to know more details about the categories or specific pieces of personal information we collect (including how we use and disclose this information), to delete their personal information, to opt out of any “sales” that may be occurring, and to not be discriminated against for exercising these rights.

California consumers may make a request pursuant to their rights under the CCPA by contacting us by email at team@nim.video. Please note that you must verify your identity and request before further action is taken. As a part of this process, government identification may be required. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government-issued identification.

Other sites and services

Our Site and Services may contain links to websites, mobile applications, and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications, or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications, and online services you use.

Security

We use several technical, organizational, and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.

Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including satisfying any legal, accounting, or reporting requirements, establishing or defending legal claims, or preventing fraud. To determine the appropriate retention period, we consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the information and whether we can achieve those purposes through other means, and applicable legal requirements.

International data transfer

We are headquartered in the United States and may use service providers that operate in other countries. Consequently, your personal information may be transferred outside the United States to locations where privacy laws may not offer the same level of protection as those in your state, province, or country.

If you choose to use our Services from the EEA, the UK, or other regions with different data protection laws, please be aware that you are transferring your personal information outside of those regions to the United States for storage and processing. We may transfer personal information from the EEA or the UK to the United States and other countries based on applicable data protection laws.

By providing any information, including personal information, through our Site or Services, you consent to such transfer, storage, and processing.

Children

The Service is not intended for use by anyone under 13 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us. If we learn that we have collected personal information through our Site or Services from a child without the consent of the child's parent or guardian as required by law, we will comply with applicable legal requirements and make commercially reasonable efforts to delete the information.

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Site or through other appropriate means. Any modifications to this Privacy Policy will be effective upon posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of our Site or Services after the effective date of any modified Privacy Policy indicates your acknowledging that the modified Privacy Policy applies to your interactions with the Site and Services.
